About Mbogiwood
Mbogiwood Productions PLC ("Mbogiwood", "we", "us") respects your privacy and the importance of protecting your personal information. Mbogiwood is a premiere production company for short and feature films that merges art and digital advocacy. Silent Bruises is a film we produced that highlights unspoken stories of gender-based violence and aims to create a safe space for healing and community dialogue.
This Privacy Notice explains how we collect, use, store and protect personal data from individuals who voluntarily share their experiences with us as part of the Silent Bruises advocacy campaign. For the purposes of this Privacy Notice, "personal data" means any information relating to an identified or identifiable individual, including written, audio, or video stories you choose to share with us.
What We Collect
For the purposes of this campaign, “personal data” means any information relating to an identified or identifiable natural person (“data subject”). An identifiable natural person is someone who can be identified, directly or indirectly, for example by their name, identification number, location data, online identifier, or by factors specific to their physical, physiological, genetic, mental, economic, cultural, or social identity, including sensitive information such as HIV status.
During the Silent Bruises campaign, we provide a platform for victims and survivors of gender-based violence to anonymously and voluntarily share their stories, including experiences they may not have shared before. You decide how much to disclose, such as whether to include your name, photo, HIV status, or any other identifying details. If you choose not to provide identifying information, the context of your story alone is enough. All stories are treated as anonymous unless you explicitly give us permission to share your identity.
How We Collect Data
We collect stories at Silent Bruises events related to the film, where private booths allow you to freely write or record your experiences. You may share your story through a written note or an audio recording. We also collect stories via our social media channels (for example, Instagram direct messages), where we continue to respect your anonymity. Participation is entirely voluntary.
Purpose and Use of Data
Your story is a vital part of the Silent Bruises advocacy campaign on gender-based violence. By sharing, you help create a safe, supportive space for healing and dialogue, while raising public awareness and inspiring change. We may feature your story on social media, in printed materials, or at events linked to Silent Bruises. Your story will never be used for unrelated or commercial purposes without your explicit consent.
How We Handle Your Data
Any personal data collected during this campaign is processed through a mix of manual and limited automated methods. Staff manually receive and review stories, while automated tools are used solely for secure storage and scheduling posts, as described in this Notice. Before publication, each submission is reviewed to ensure anonymity and appropriateness. Stories may be edited for clarity, length, or anonymity while preserving their meaning and context, and volunteers or trusted service providers may assist with editing, design, posting, or translation.
How We Protect Your Information
We maintain appropriate technical and organisational safeguards to protect personal data against unauthorised access, accidental loss, destruction or damage.
How Long We Keep Your Information
We will keep your personal data (such as your name, contact details and any identifiers you provide) only as long as necessary for the purposes of this campaign and in any case no longer than two (2) years from the date of consent. After this period your personal identifiers will be deleted or anonymised.
However, the anonymised version of your story may continue to be used under the licence you grant us in the Consent & Release Form below for advocacy and awareness purposes connected to Silent Bruises for as long as necessary to fulfil those purposes, even after your personal data has been deleted.
Request and Review
You may at any time request information about how we process your personal data, request correction or removal of your personal details, or ask us to stop using your story. We will remove it from our own channels wherever possible but cannot guarantee removal from third-party sites or undo past uses. You also have the right to withdraw your consent for future processing. To exercise your rights, please contact us atadmin@mbogiwood.co.ke. Possible Risks of Sharing
Sharing your story can be empowering, but it may also bring up painful memories or emotions. In addition, because your story may be shared publicly on social media or at events, seeing it circulated or discussed could also trigger distress or re-traumatization. If you experience emotional distress during or after participating, we encourage you to reach out to support services or helplines for assistance. A list of relevant helplines and support contacts will be provided at our events and on our social media pages so you can easily access help when you need it. Your well-being is our highest priority, and participation in this campaign is entirely voluntary.
Consent & Release Form
This Consent and Release Form records your permission for Mbogiwood to collect your story and to use it for the advocacy campaign. Participation in this campaign is completely voluntary. By signing this document, you acknowledge that you have read and understood Mbogiwood’s Privacy Notice above and that you freely consent to the collection, processing and use of your personal data and materials in accordance with the Notice.
Definitions
- Advocacy Campaign: a coordinated set of activities designed to raise public awareness, inform, educate or influence attitudes and behaviours on a specific social issue… limited to activities under the Silent Bruises project.
- Consent: your written permission for Mbogiwood to collect your story in written, audio or video form, and to process your personal data for the purposes described in the advocacy campaign.
- Consent Form: a written record of a participant’s permission for Mbogiwood to collect their personal data and materials for the specific purposes described in the Silent Bruises / Mbogiwood Privacy Notice.
- Copyright: intellectual property rights under the Kenya Copyright Act, which protect original works and grant exclusive rights to reproduce, distribute, adapt, translate, perform and broadcast them. Stories you submit remain your intellectual property.
- Economic rights: rights of the copyright owner to use their work for financial or other benefit… which can be licensed or transferred.
- License: legal permission you grant to Mbogiwood to use your story, image and/or voice within the agreed scope. A licence does not transfer ownership.
- Moral Rights: rights of authors to be identified and to object to derogatory treatment of the work.
- Release: your authorisation for Mbogiwood to use, reproduce, adapt, translate, publish and distribute your story, image and/or voice, and waiver of certain claims within the agreed scope.
- Term: personal data retained for no more than two (2) years; licence to use anonymised story continues as necessary for the campaign purposes.
- Waiver: your voluntary decision to allow reasonable edits/formatting for publication while preserving essential meaning and context.
Grant of Consent and Release
- Consent to Collection and Processing of Personal Data. You voluntarily consent to Mbogiwood collecting, storing and processing your personal data and your story in written, audio and/or video form as part of the advocacy campaign. Personal identifiers are retained for no more than two (2) years from the date of the form, after which they are deleted or anonymised unless a longer period is required by law.
- Purpose. Your story/recordings will be used solely for advocacy, educational, promotional and public-awareness purposes connected to the campaign and not for unrelated or commercial purposes without further consent.
- Licence under the Copyright Act. You grant Mbogiwood a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, adapt, translate, publish, distribute, communicate to the public and create derivative works from your story, audio or video for the purposes described above, without expectation of payment.
- Duration of Licence. The release continues beyond the two-year data retention period, for as long as necessary to fulfil the stated purposes.
- Waiver of Moral Rights. To the fullest extent permitted by the Kenya Copyright Act, you waive moral rights that would restrict reasonable edits, translations or format changes while preserving essential meaning and context.
- Risks of Disclosure. Identification may still occur from details you disclose. Once posted online, content may be copied or redistributed beyond Mbogiwood’s control.
- Right to Request Cessation. You may request that Mbogiwood cease further use of your story and remove it from its channels where feasible; removal from third-party sites cannot be guaranteed.
- Release of Claims. You release and discharge Mbogiwood and its partners from claims arising out of collection, storage, processing or use of your personal data or content in accordance with this Consent and Release.
- Voluntary Participation and No Compensation. Participation is voluntary and without compensation.
