Terms & Conditions

These Terms & Conditions ("Terms") govern your participation in and use of Mbogiwood Productions PLC ("Mbogiwood") Silent Bruises advocacy campaign, including our events, booths and online channels where stories are collected and shared. By submitting a story or otherwise participating, you agree to these Terms.
1. Eligibility & Voluntary Participation
- Participation is voluntary. You may choose to remain anonymous.
- If you are under 18, a parent or legal guardian must provide consent for you to participate.
2. Submissions & Licence
- You retain copyright in the materials you submit (written, audio or video). You grant Mbogiwood a non‑exclusive, royalty‑free, worldwide licence to use your submission for advocacy, educational, promotional and public‑awareness purposes connected to the campaign, including to reproduce, edit for clarity and anonymity, translate, adapt, publish, distribute and create derivative works. No compensation is due.
- The licence continues beyond the two‑year retention period for personal identifiers, for as long as reasonably necessary to fulfil the campaign purposes.
3. Anonymity & Sensitive Content
- We treat stories as anonymous unless you explicitly grant permission to reveal your identity. Be cautious not to include details that could identify you or others if you wish to remain anonymous.
- Submissions should avoid naming alleged perpetrators or sharing information that violates others’ privacy, court orders, or applicable laws.
4. Prohibited Conduct
- Do not submit content that is unlawful, defamatory, hateful or otherwise harmful.
- Do not infringe third‑party rights, including privacy, publicity or intellectual property rights.
- Do not attempt to disrupt our services or platforms.
5. Moderation & Takedown
Mbogiwood may review, edit for anonymity/clarity, or decline to publish any submission at its discretion. We may remove content from our channels if we believe it violates these Terms or applicable law.
6. Privacy
Our processing of personal data is described in our Privacy Notice. Among other things, we keep personal identifiers no longer than two (2) years, and may continue using anonymised stories for the purposes of the campaign under the licence you grant.
7. Health & Safety
Sharing experiences of gender‑based violence can be distressing. Support contacts and helplines will be available at events and on our social media. Seek help if you feel overwhelmed.
8. Disclaimers
The campaign and related platforms are provided "as is" without warranties of any kind. We do not endorse or verify the accuracy of participant stories and are not responsible for user‑generated content.
9. Limitation of Liability
To the maximum extent permitted by law, Mbogiwood will not be liable for indirect, incidental, special or consequential damages arising from your participation or submission.
10. Indemnity
You agree to indemnify and hold harmless Mbogiwood and its officers, employees, agents, volunteers and partners from claims arising out of your submissions or breach of these Terms.
11. Termination
We may suspend or terminate your ability to participate if you violate these Terms or if required by law.
12. Governing Law
These Terms are governed by the laws of Kenya. You may contact the Office of the Data Protection Commissioner (ODPC) regarding data‑protection issues as described in the Privacy Notice.
13. Changes
We may update these Terms from time to time. We will indicate the effective date above.
